Auto Accident Questions
CAPE CORAL, FORT MYERS, LEE COUNTY, FLORIDA
If you are involved in an auto accident in Florida, the state’s “no-fault” laws apply. The term “no-fault” means that your Personal Injury Protection (PIP) coverage automatically covers eighty percent of your medical bills and up to sixty percent of lost wages regardless of who caused the accident. The remaining twenty percent is covered only if you previously purchased medical payments coverage as part of your auto insurance coverage.
To recover damages for pain and suffering, mental anguish, and similar issues, the state of Florida has set a threshold. The injured party must prove:
- Significant and permanent loss of an important bodily function
- Permanent injury within a reasonable degree of medical probability, other than scarring or disfigurement
- Significant and permanent scarring or disfigurement
- Death
For Florida drivers, the purchase of additional Uninsured / Underinsured Motorist Insurance is highly recommended, since Florida law does not require drivers to purchase Bodily Liability insurance to pay for your additional medical bills, and lost wages in the event of an accident.
